An attorney has no implied authority to settle a case without the consent of his client and, hence, a settlement agreement negotiated by an attorney, without the consent of his client, is not personally binding on the client (see Countryman v. Breen, 241 App. Div. 392, affd. 268 N. Y. 643; see, also, Silver v. Parkdale Bake Shop, 8 A.D.2d 607; Ricketts v. Pennsylvania R. Co., 153 F. 2d 757). Disposition Appeal from order dated May 19, 1969 dismissed, without costs.
